  4. The community involved in this consumption must be composed of a small number of persons who allow us to consider that we are facing an intimate act without public importance (STS of 3 March 1995).
  5. Consumers must be specifically identified, in order to be able to properly control both the number of consumers, in relation to the above condition, and their personal conditions, with regard to the first statement (STS of 31 March 1998).
  6. This should be immediate consumption (STS of 3 February 1999).

It is certainly very difficult for a cannabis association to meet each one of these requirements, which places its partners, but above all the members of the Board of Directors, in an absolute vulnerability to a possible criminal case against it. This leads to the obvious conclusion that, faced with a reality as overwhelming as there are more than 400 cannabis associations today in Catalonia, this figure of “shared consumption” must be revised and reformulated in accordance with this social reality.

Cannabis is the most widespread illegal drug in Spain and in the European Union.
